Terms and Conditions of Entry for the Prezzee Recipient Survey

 

The Promoter of this offer is Prezzee Inc. of 368 9th Avenue New York, NY 10001, United States of America (the Promoter).

The Promotion is subject to the following terms and conditions:

  1. By participating in the promotion, entrants accept and agree to be bound by these Terms and Conditions.
  1. Entries must comply with these terms and conditions to be valid.

The Promotion

  1. The promotion will commence at 7:00 PM GMT on 25 May 2025 and finish at 7:00 PM GMT on 5 June 2025 (Promotion Period).
  1. The promotion has three (3) prize, being 3 x $70 Prezzee Smart eGift Card issued by the Promoter (the Prize).
  1. Use of the Prize is governed by the Promoter’s Terms of Service. 
  1. Prizes are not transferable, non-exchangeable nor redeemable for cash. 
  1. The total prize pool value is $210.
  1. All prices and values in these Terms and Conditions are stated in US dollars and are inclusive of any taxes to the extent they are applicable. 
  1. The Promotion is open to United States of America residents over the age of 18 years old who meet all eligibility criteria set out in these Terms and Conditions.

How to Enter

  1. To enter, entrants must during the Promotion Period: 
    1. complete the Prezzee Prezzee Recipient Survey (the Survey); and 
    2. submit their details in the entry form featured at the end of the Survey. 
  1. For each Survey completed, eligible entrants will receive one (1) entry into the promotion.

  2. There is no entry fee, and no purchase required to enter the promotion. 
  1. All submitted Surveys and entries become the property of the Promoter. By submitting an entry to the Promoter, you warrant you are the owner of the intellectual property rights in the content, and you voluntarily waive all moral rights that you may have in such content or entry.

 

How Winners are Determined

  1. The promotion is a game of chance.
  1. At 7:00 PM GMT on 15 June 2025, each valid entry will be entered into a process of random selection. Three (3) winning entries will be selected at a random draw (Winner).  The random draw will take place at Level 3, 9 Castlereagh Street, Sydney NSW 2000, Australia.
  1. The Promoter’s selection of the winning entry will be final and binding. No correspondence with entrants or any other person will be entered into.

Claiming the Prize

  1. The Winner will be notified by email within seven (7) business days of the draw.
  1. The Prize will be emailed to the Winner’s email address that is held on record by the Promoter at the time of prize draw within seven (7) business days of the draw date.
  1. If a Winner does not claim the Prize within three (3) months from the date of the prize draw, the entry will be deemed invalid and a redraw will take place at Prezzee Pty Ltd (ABN 16 602 963 422) of Level 3, 9 Castlereagh Street, Sydney, NSW 2000 Australia at 7:00 PM GMT on 15 September 2025.
  1. It is the responsibility of each entrant to notify the Promoter of any change in their contact details.
  1. The Promoter shall have no liability for a Winner’s failure to receive notices due to spam, junk-email or other security settings, for a winner’s provision of incorrect or otherwise non-functioning contact information. 
  1. The Promoter is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any website, or any combination thereof, or any other technical failures, including but not limited to any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading any materials in this promotion. 
  1. Directors, employees and contractors (and their immediate families) of the Promoter, its related companies or its agencies, are not eligible to enter this promotion.  Immediate family means spouse, ex-spouse, child, step-child, parent, step-parent, legal guardian, sibling or step-sibling

Other Terms

  1. If the Prize is unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the Prize with a prize of equal or greater monetary value. This right is subject to any applicable legislation, regulations or directions from a regulatory authority.
  1. A Winner’s use of the Prize is entirely at their own risk. The winners release the Promoter from and indemnify the Promoter from and against any liability arising from the Winner’s acceptance and use of the Prize and the Winner’s participation in the Promotion.
  1. To the extent permitted by law, the Promoter and its related entitles and their respective directors, officers, employees and agents will not be liable for any personal injury, loss or damage, whatsoever which is suffered or sustained (including, but not limited to indirect or consequential, financial or other loss) to or by an entrant or Winner.
  1. This Promotion cannot be used in conjunction with any other offer. 
  1. The eligibility of entries is solely within the discretion of the Promoter.
  1. The Promoter accepts no responsibility for late, lost, misdirected or damaged entries or other communications.
  1. The Promoter reserves the right to vary the terms of, or cancel, the promotion at any time without liability to any entrant or other person.
  1. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules.
  1. These terms and conditions are subject to change.  For more information on how we use data, please see our Privacy Policy.  By participating in the Promotion, Entrants hereby agree to Promotor’s collection and usage of their personal information and acknowledge that they have read and accepted Promoter's Privacy Policy.
  1. The Promoter reserves the right, at any time, to request verification of the age, identity, residential address or any other information relevant to participation in the Promotion of all entrants. The Promoter reserves the right to disqualify any entrant who provides false information or fails to provide information that is reasonably requested by the promoter.
  1. The Promoter reserves the right, in its sole discretion, to refuse to accept entries which are incomplete, indecipherable, offensive, do not comply with these terms and conditions, or which contravene any applicable laws or regulations.
  1. The Promoter reserves the right, in its sole discretion, to disqualify any entrant who has breached any of these terms and conditions, has engaged in unlawful or improper conduct, or otherwise acts to cheat or undermine the fairness of the Promotion by, for example, tampering with, or using or exploiting errors in, the entry process to obtain a competitive advantage over other entrants.
  1. These terms and conditions shall be governed by the laws of New York and any dispute shall be subject to the exclusive jurisdiction of New York courts.
