Please read the following Terms of Sale carefully
In your purchase of products from Prezzee, you agree to be bound under the Terms of Sale (including any disclosures made to you at the time of purchase and/or when a Gift Card (as defined at clause 1.1) is provided to the recipient) effective at the time of your purchase and all terms and policies incorporated by reference. Should you not agree to all of these terms, do not make any purchases from Prezzee. Prezzee Pty Limited (Australia), Prezzee Limited (New Zealand), Prezzee Inc (United States), Prezzee UK Limited (United Kingdom), Prezzee Canada Corporation (Canada) and any other trading entities that are authorised to provide Prezzee’s services (“Prezzee”, “we” or “us”) make products available for purchase via our websites (“Site”), mobile applications (“App”) and other products and services (collectively, the “Services”). Your purchase of any products through these is governed by these Terms of Sale (“Terms”) and your use of the Services is governed by our Terms of Service available at Terms of Service (available via the Service). We reserve the right to change or modify these Terms at any time at our sole discretion, except if you are a consumer that resides in Ontario or you are a Quebec consumer or an individual recognised as a consumer by Quebec courts, in which case the paragraph below will apply for all changes made to these Terms. Should we make changes to these Terms, notice will be provided such as through sending you a notification, providing notice through the Services or by updating the “Last Updated” date at the top of these Terms. We strongly advise you to review these Terms each time you make a purchase from Prezzee so as to ensure that you understand the terms and conditions applicable to your purchase.
FOR NEW ZEALAND USERS, “PREZZEE” IS A TRADE MARK OF US AND OUR PARENT COMPANY, PREZZEE PTY LIMITED (ACN 602 963 422), A COMPANY INCORPORATED IN AUSTRALIA, AND WE ARE NOT ASSOCIATED IN ANY WAY WITH “PREZZYⓇ”, “PREZZYⓇ CARD” OR EPAY NEW ZEALAND LIMITED (NZBN 9429036203420) AND PREZZYⓇ IS A REGISTERED TRADE MARK OF EPAY NEW ZEALAND LIMITED.
For Ontario and Quebec consumers and individuals recognised as consumers by Quebec courts only. Notwithstanding the foregoing and any other provision in these Terms that refers to our right to change or amend the Terms, if you are a consumer that is located in the province of Ontario or Quebec, we reserve the right to amend these Terms with respect to any provisions that apply to the Services offered, any related fees or charges, the App, Site, Gift Cards available, our responsibilities or obligations under these Terms, your responsibilities under these Terms, any disclaimers, limitation of availability and indemnification (collectively, "Changes") every six (6) months. If we make Changes to these Terms, in addition to posting the revised Terms on the Site, we will also provide you at least thirty (30) days’ advance notice of such amendments in accordance with applicable law ("Notice"). Upon receiving the Notice, if you do not agree with the amendments, you must stop using the Services and you may refuse the amendments and terminate your relationship with us and the related contracts, by sending us a notice to that effect within the time specified in the Notice (and, if you are a consumer or individual recognised as a consumer by Quebec courts and you reside in Quebec, the Notice can be sent within thirty (30) days after the effective date of the Change if the Change entails an increase in your obligation or a reduction of our obligations). If you do not notify us within the required time, the Changes will take effect, as indicated in the Notice. In that case, you will be deemed to agree to the Changes which will become part of these Terms and enforceable against you. If you terminate your relationship with us, we will no longer provide Services to you, but you will continue to be liable for any amounts owing to us and all provisions that by their nature are intended to survive termination of the Terms will continue to apply.
For users in Canada. You agree to receive, in electronic form, a copy of these Terms, any required disclosures and all other notices, information or communications we may be required to send to you from time to time under applicable law. You agree to keep a copy of any electronic communications, including a copy of these Terms, for your records and future reference. Any notices or other communications will be deemed to be delivered when emailed to your designated email address, as provided or updated by you from time to time.
Please read this document carefully as these Terms, and the other documents incorporated by reference which form part of these Terms, describe the legally binding agreement between you and Prezzee that apply to your purchase through the Site or the App. The date of the agreement is the date you purchase a Gift Card. In addition to the disclosures provided to you when you purchase a Gift Card (such as, information regarding the Gift Card (as defined in clause 1.1) and related Retailer (as defined in clause 4) terms and conditions, all applicable fees, charges and related costs, if any, total purchase price, payment terms and delivery arrangements), these Terms also include the details of any warranties or guarantees that apply to your purchase, cancellation, return, exchange and refund policies, if any, and all other restrictions, limitations or conditions of purchase that may apply.

- Availability and Pricing
- A variety of non-reloadable digital Gift Cards, codes and/or vouchers from over hundreds of brands worldwide are offered for purchase through our Services (collectively, “Gift Cards”). All Gift Cards are subject to availability, and we reserve the right to impose quantity limits on any order, reject all or any part of an order and to discontinue products without notice, even if you have already placed your order. All prices are subject to change without notice and the price charged will be the price set out on the Service at the time of your order.
- Depending on which jurisdiction you are purchasing the Gift Cards, the following minimum and maximum limits apply in relation to your purchase of Gift Cards from us:
- Gift Cards purchased through Prezzee are available for use within the country in which you purchased the Gift Cards and may be available for use in or sending to recipients in other countries. Please consult the Prezzee Gift Card wall via the Service and each Retailer’s (as defined below) terms and conditions for the use of Gift Cards outside of the country in which you purchased the Gift Cards.
- Gift Cards
- From time to time we may offer other special promotions intended to provide you an incentive to purchase Gift Cards from the Retailers (“Retailer Gift Cards”) and/or to encourage you to get others to do so. The applicable rules will be posted on the Site in or near the description of each such promotion and/or competition. We reserve the right to cancel any promotions without notice and interpret these rules in our sole discretion, and you hereby agree to our interpretation.
- The expiration date for a Gift Card, if one applies, is displayed on or on the back of the Gift Card in your digital wallet or in the Retailer’s own terms and conditions. Your digital wallet is automatically created in your account (unless you access our Services as a guest) where all your Gift Cards are stored and where you can check the balance of, manage and redeem your Gift Cards and view Retailer terms and conditions (“Prezzee Wallet”). Please refer to the expiry date to ensure you redeem your Gift Card in the allocated time frame. Prezzee is not responsible for users to redeem their Gift Card before the expiration date.
- Unless otherwise stated by the applicable Retailer or required by law, Gift Cards are not redeemable for cash.
- Each Gift Card purchased by you will be listed as a separate Gift Card. By way of reference, in the event that you purchase two Gift Cards from the same Retailer, your wallet will reflect two Gift Cards, as opposed to one Gift Card with the value of the two Gift Cards purchased. Prezzee may, in its sole discretion and under guidance by relevant laws, from time to time implement a limit on the value of Gift Cards that may be stored in the Prezzee Wallet at any one time.
- You are responsible for your Gift Card - go to clauses 12 and 13 for further details. Prezzee is not responsible if a Gift Card is lost, stolen, destroyed, or used without permission. Prezzee is not responsible if any Gift Card is rendered unsuitable for redemption through no fault of Prezzee. If you have lost or misplaced your Gift Card and the balance has not been spent or changed from the original amount, contact us using the details set out at clause 16, and we will send you a replacement provided we can confirm the balance is unused.
- Redeeming Gift Cards
In order to redeem a Gift Card, you will need to register an account. When an account is created, your email address and phone number must be provided. Further information is available under ‘Your Prezzee Account’ in the Terms of Service available at [insert link to the new Global Terms of Service once uploaded].
- Retailer Terms and Liability
Retailer Gift Cards that you purchase through our Services are issued by participating third-party retailers (“Retailers”). Your purchase of each Retailer Gift Card is governed by certain terms and conditions established by the issuing Retailer in addition to these Terms. Retailers may set expiration dates for Retailer Gift Cards in addition to other restrictions and requirements. Please review all applicable Retailers’ terms and conditions prior to the purchase of any Retailer Gift Card. If you have questions relating to the applicable Retailer terms, please contact the issuing Retailer. As the issuers of Retailer Gift Cards, Retailers (and not Prezzee) are fully responsible for all aspects of their Gift Card programs. Retailers are responsible for all liabilities and costs suffered by you or any other party caused – directly or indirectly – by the Retailer or their products or services. We have no obligation to resolve any dispute between you and any Retailer. Prezzee endeavours to work with reputable Retailers, however Prezzee holds no liability for the sale of products or services provided to you by a Retailer. In purchasing a Retailer Gift Card from an issuing Retailer, you waive and release Prezzee and its subsidiaries, affiliates, partners, officers, directors, employees and agents from any liabilities arising from or related to any act or omission of a Retailer. Following the purchase of a Retailer Gift Card, Prezzee shall not be responsible or liable to you in the event a Retailer discontinues its Retailer Gift Cards or is unable to or refuses to redeem a Gift Card (including for reasons of their insolvency, external administration or forced closure). Neither Prezzee nor any Retailer is responsible for lost or stolen Retailer Gift Cards. If you lose your mobile device, please contact us using the details set out at clause 16 immediately so we can put a hold on your account.
- Recommended Retailer eGift Cards
- A Recommended Retailer eGift Card allows the purchaser to recommend a particular Retailer Gift Card to their recipient, and the recipient then has the opportunity to either take the Recommended Retailer eGift Card issued to them (if available on the Service at that time), or swap it for a different Retailer Gift Card of their choice of equal value (if available on the Service at that time).
- If a Gift Card is Recommended Retailer eGift Card, it will display the brand of the recommended Retailer and the product purchase page will include a notice that says “more choice, more joy! Your giftee will be able to choose where to spend their gift”.
- Recommended Retailer eGift Cards are issued by Prezzee at the time of purchase (and not by the Retailer that has been recommended to the recipient).
- For users in Australia, New Zealand and the United Kingdom, the Recommended Retailer eGift Card expires on the date displayed (or after the timeframe displayed) on the product purchase page and in the Prezzee Wallet. After the date or timeframe identified as the expiry date displayed on the product purchase page or in the Prezzee Wallet has lapsed, the Recommended Retailer eGift Card will expire.
- For users in Canada or the United States, the Recommended Retailer eGift Card does not expire, and during this period it can be exchanged by the recipient for a Gift Card issued by the displayed Retailer (if available on the Service at that time) or for Gift Cards of another participating Retailer available on the Service of equal value.
- To confirm that you wish to convert your Recommended Retailer eGift Card into a Gift Card issued by the displayed Retailer, select “keep this card” in your Prezzee Wallet. To swap your Recommended Retailer eGift Card to another brand, select “swap for another brand”. If the Retailer displayed on the Recommended Retailer eGift Card is no longer available on the Service, you can swap it to another participating Retailer Gift Card of equal value available on the Service.
- Once you have confirmed your Gift Card selection and a Retailer Gift Card has been issued, this selection cannot be reversed or refunded except as required by law. The Retailer Gift Card may have a new expiry date (displayed in the Prezzee Wallet) and the terms and conditions of the selected Retailer Gift Card will apply.
- For the avoidance of doubt, Retailer Gift Cards that offer a special promotion will not have the swap functionality and are not Recommended Retailer eGift Cards.
- Not all Retailers participate in Recommended Retailer eGift Card. The Retailers who participate in the Recommended Retailer eGift Card are subject to change from time to time.
- Prezzee Smart eGift Card
- The Prezzee Smart eGift Card allows users to buy and send a non-reloadable value onto the Prezzee Smart eGift Card which can be exchanged for another Retailer Gift Card available on the Prezzee Service for the same amount.
- If the Prezzee Smart eGift Card does not display the brand of a particular retailer, it can be exchanged for multiple participating Retailer Gift Cards up to the value displayed on the Prezzee Smart eGift Card. If the Prezzee Smart eGift Card displays the brand of a particular retailer, it can only be exchanged for one Retailer Gift Card of equal value.
- There are no fees associated with the Prezzee Smart eGift Card.
- The Prezzee Smart eGift Cards are valid for, when issued in:
- Australia - 3 years;
- New Zealand - 2 years;
- United States – an unlimited period;
- Canada – an unlimited period;
- United Kingdom - 24 months; or
- Ireland - 5 years,
or such other period prescribed by law in the relevant jurisdiction from time to time, for users to exchange Retailer Gift Cards of their choice. Once the new Retailer Gift Card(s) has been selected new expiry dates will be set and terms and conditions apply to the specific Retailer Gift Card(s) chosen.
- Prezzee Smart eGift Cards are not redeemable for cash and no refunds will be provided for Prezzee Smart eGift Cards (except as required by law). References in these Terms, the Terms of Service or elsewhere on the Service to "Smart eGift Card" are also taken to refer to the "Prezzee Swap Card" or “Swappable Gift Card” as names are used interchangeably. Additionally, if a Gift Card includes the words ‘issued by Prezzee’ then it is a Prezzee Smart eGift Card and the terms in this paragraph apply.
- Payment Options
Accepted forms of payment are credit cards and/or debit cards approved by Prezzee (a “Card”) for example Visa, MasterCard, JCB, American Express, PayPal and/or ApplePay, and other payment options (such as buy now pay later – those payment options may be subject to separate terms and conditions). Prezzee reserves the right to make changes to the payment methods available for use without notice. Gift Cards may not be purchased with cash. Unless indicated otherwise, the purchase of Gift Cards will be fully billed at the time the Gift Card is issued to you. Prezzee does not hold any financial information- when you make a payment by Card, the transaction information is handled by a third party PCI compliant payment processer and when you make a payment using another payment option, the transaction information will be handled by the payment option provider. If your payment cannot be verified, is invalid or otherwise unacceptable, your order may be suspended or cancelled automatically. Card processing fees may apply even if the Card has expired or changed by the time Prezzee submits the charges. Any problems encountered with respect to payment for your order are not the responsibility of Prezzee, and you should resolve your concerns with the payment provider.
- Why do I see an extra $1 on my statement?
When you attempt to store a card to be charged later, our payment processor may send over a request to your issuing bank for either a $0 or a $1 (or the local currency equivalent in the country from which you access our Services) authorisation to verify that the card is issued and the bank will allow it to be authorised. Our payment processor will first attempt a $0 authorisation. If the $0 authorisation fails, they will then attempt a $1 authorisation. Regardless of whether or not the authorisation is accepted or declined, we reverse the amount immediately. Some people may still see an authorisation for $1 on their credit card statement. The important thing to remember is that this is not a charge, and it will disappear from your statement. Depending on the bank, it will be removed in anywhere from a few minutes to a few weeks.
- Taxes
Gift Cards are free of GST/VAT. GST/VAT or other taxes are not accounted for until the cards are used to purchase goods. These may be charged separately by the applicable Retailer at the time of purchase.
- Gift Card Activation
All Gift Cards sold via our Services are already activated at time of purchase. Activated Gift Cards will be available within approximately 30 seconds however additional time may be required for certain activations. If your Gift Card has not been activated within five minutes, please contact us using the details set out at clause 16. In rare cases it may take up to 24 hours for activation to occur, we appreciate your patience.
- Cancellations; Returns
- Please choose carefully as we do not offer exchange or refund on Gift Cards.
- For users in the United Kingdom, when you place an order for a Gift Card, it can be used straight away. In doing so you consent to it being supplied immediately and you acknowledge and accept that your right to cancel within the 14-day cancellation period (and therefore your right to a refund) will be immediately lost. Your statutory rights are not affected.
- A re-issue of faulty or damaged Gift Cards is not available unless the fault or damage to the Gift Card is proven to be a result of the production or issuing process or otherwise due to the fault of us or our agents or contractors or where otherwise required by law. If you seek a return or refund please contact us using the details set out at clause 16, with the reason for your request and proof of purchase for us to review. If any value on a Gift Card has been spent, we will be unable to process a return or refund unless required to by law. Prezzee is not responsible for the refund of purchase price or return of any products purchased from Retailers.
- Lost or Stolen Gift Cards
Treat your Gift Card like cash. Lost or stolen Gift Cards will not be replaced or refunded. The bearer of the Gift Card will be taken to be the owner of the Gift Card. If you lose your mobile device, please contact us immediately so we can put a hold on your account. If someone has partially or fully redeemed your Gift Card(s) while your mobile device is lost or stolen (or otherwise used without your consent), Prezzee shall not be liable.
- Your Gift Card, your responsibility
You are responsible for the use and safety of your Gift Card. You are liable for all transactions on your Gift Card, except to the extent to which there has been fraud, negligence or wilful misconduct by us. Protect your Gift Card information by viewing it in privacy to ensure no one views and records your Gift Card information. We strongly encourage all users to have a passcode on your mobile device.
- Errors
Prezzee attempts to be as accurate as possible however sometimes errors may occur. We do not represent or warrant that any description, Gift Card (including the balance and expiry dates of, or any other information relating to, the Gift Cards), Retailer or pricing information displayed on our Service is accurate, complete, reliable, current or error-free. In the event of an error caused by us, we will endeavour to correct it as quickly as possible and revise your order accordingly, or to cancel the order and refund any charged amount.
- Excluded Users and Territories
You are not permitted to purchase products or services from Prezzee if you are:
- located in, under the control of, a national or resident of any country to which the country from which you access our Services has embargoed goods or services, or that has been designated by its government as a “terrorist supporting” country; or
- identified as a “Specially Designated National”; or
- placed on any export control list (or list of prohibited or restricted parties) of the country from which you access our Services; or
- a user in Canada and a person that is listed or designated in any economic sanctions laws, regulations, orders, embargoes or restrictive measures administered, enacted or enforced by the Canadian Government, including Global Affairs Canada (and any successor thereto), any sanctions or requirements imposed by, based upon the obligations or authorities set forth in, Canada’s United Nations Act, the Special Economic Measures Act (Canada), the Justice for Victims of Corrupt Foreign Officials Act (Canada), the Criminal Code (Canada), and the Freezing of Assets of Corrupt Foreign Officials Act (Canada), in each case, as amended from time to time, including any person named on the “Consolidated Canadian Autonomous Sanctions List” produced by Global Affairs Canada: Consolidated Canadian Autonomous Sanctions List (international.gc.ca).
